David C. Cimo specializes in all aspects of commercial litigation, creditors' rights, restructuring, and bankruptcy in federal and state courts. He represents clients in various complex commercial litigation matters, with an emphasis on representing plaintiffs, including court-appointed fiduciaries, in the prosecution of director and officer liability litigation, legal and accounting malpractice liability litigation, complex fraudulent transfer/preference avoidance litigation, and bank liability litigation.
Cimo's practice involves prosecuting and defending complex litigation claims on behalf of trustees, debtors, creditors and creditors' committees in large-asset, litigation-intensive Chapter 7 and 11 bankruptcy proceedings, and receivers, statutory assignees, and creditors in federal and state insolvency and receivership proceedings. He also represents parties involved in fraudulent transfer litigation, contract disputes, insurance disputes, foreclosures, and collection and post-judgment collection matters.
Cimo is "AV" rated by Martindale-Hubbell and is a Fellow in the Trial Lawyer Honorary Society of the Litigation Counsel of America. Cimo is a member of The Florida Bar and is admitted to practice before the U.S. Supreme Court, the Eleventh Circuit Court of Appeals, the U.S. District Courts for the Southern and Middle Districts of Florida, and the U.S. Bankruptcy Courts for the Southern and Middle Districts of Florida. He is a 1988 cum laude graduate of the University of Miami School of Law, where he was an article and comments editor of the Entertainment and Sports Law Journal. Cimo earned a bachelor of arts, with honors, from Florida Atlantic University in 1985.
