Our practice extends to family and disability benefits and employee protections including those for maternity leave, HIV/AIDS and other life-threatening illnesses. We put special emphasis on monitoring legal developments with respect to the Americans with Disabilities Act (ADA), Title VII of the Civil Rights Act, the Family and Medical Leave Act (FMLA), continuation of insurance coverage under COBRA, the Federal Fair Labor Standards Act, and various state labor and employment laws.
GJB is a leading firm in providing representation arising under the Americans with Disabilities Act (ADA). We have defended a major oil company and a worldwide fast food franchisor in nationwide class actions brought under the ADA. We also represent numerous other clients in ADA actions involving issues material to places of public accommodation. Additionally, we have negotiated consent decrees with the U.S. Department of Justice resolving issues of ADA compliance.
Our attorneys regularly counsel employers as to their obligations under the Fair Labor Standards Act (FLSA). Additionally we have successfully prosecuted many national FLSA class actions suits on behalf of employees of major corporations regarding overtime pay claims, which have resulted in settlements providing for the payment of millions of dollars to class members. The firm has recently concluded a national suit against Credit Suisse First Boston, recovering overtime pay for the worldwide brokerage firm's nonexempt U.S. employees.
GJB also has drafted and extensively negotiated executive employment and employment separation agreements on behalf of both employers and executive employees, addressing such issues as incentive compensation, confidentiality, non-competition clauses and waiver of the right to sue under various anti-discrimination acts.
